Part A — Terms for Be Pieceful today

1. About these terms

Be Pieceful is a daily jigsaw puzzle game at bepieceful.com and in the Be Pieceful iOS app, operated by [LEGAL ENTITY NAME] ("we", "us"), of [REGISTERED ADDRESS].

By playing Be Pieceful you agree to these terms. If you do not agree with them, please do not use the game. Our Privacy Policy explains what we do with your data and forms part of these terms.

If you use the iOS app, Apple's App Store Terms of Service also apply to you, and where they conflict with these terms about the App Store itself, Apple's terms win. Section 17 sets out the specific things Apple requires us to say.

We have tried to write these in plain language. Where something is a real legal restriction on what you can expect from us, we have said so directly rather than burying it.

2. Who can use Be Pieceful

You may use Be Pieceful if you are at least 13 years old and in the United States or the United Kingdom, or at least 16 years old anywhere else. [CONFIRM — see decision list.] If you are under 18, please check with a parent or guardian before creating an account or subscribing.

If you create an account, the details you give us must be accurate, and you are responsible for what happens under your account. Please keep your login secure and tell us at [support@bepieceful.com] if you think someone else has access to it.

3. Playing without an account, and creating one

You never need an account to play. The full daily puzzle is available without signing in, on the web and in the app, and we intend to keep it that way.

An account adds one thing: your streak, puzzle history, pieces and settings sync across your devices instead of living only on the one you played on. When you sign in on a device you have already played on, we link that device's existing history to your account so your streak carries over.

If the device you sign in on and the account you sign in to each already have a player name, we will ask you which one to keep. The other is permanently retired — we cannot restore it, and it is held unusable for 30 days before anyone else can take it.

Please use one account per person.

4. Your player name

Everyone who plays gets a player name — a short handle like quiet-fern. It is created automatically the first time you play, and you can change it to another available name made from lowercase letters, numbers and hyphens.

A few rules, and the reasons for them:

  • A name is a licence to use it, not something you own. We do not sell names, and you may not sell, rent or transfer one.
  • You may change your name once every 30 days. Frequent renaming is how impersonation works on a service where the handle is the address your friends use.
  • When you give a name up, it is held for 30 days before anyone else can take it, so that a link a friend already pasted into a chat cannot suddenly resolve to a stranger. If you released it by renaming, you get first refusal on it for that whole window.
  • Some names are not available: names that impersonate us or suggest an official role, and names that are offensive, harassing, or clearly chosen to abuse somebody.
  • We may reclaim a name that breaks these rules, that impersonates another person or organisation, or that we are legally required to release. Where it is reasonable, we will tell you first and give you a chance to pick another.

Your player name is public to anyone who has your invite link or already knows the name. Please do not put anything in it you would not want a stranger to read.

5. Friends, invite links, blocking and reporting

Adding friends. You can add another player by their name or by an invite link they send you. Friendships need both sides to agree, and you can have up to 20 at a time. Either of you can end one at any time, without telling the other.

What friends see. A friend sees your player name, your current streak, and whether you have solved today. That is all. They do not see your email address, your solve times, or anything you own.

Invite links are shareable, so treat them as public. Anyone holding your invite link can send you a friend request. If a link gets out further than you meant, you can rotate it in the app, which stops the old one working immediately.

Blocking. You can block another player. A block is one-way and silent — the person blocked is not told, and simply stops being able to see or reach you. Do not use a second account to get around someone else's block; that is a serious breach of these terms and we will close both accounts.

Reporting. There is a report option on any player you can see. Reports reach a person, not a queue nobody reads, and we keep them so we can recognise a repeat pattern. Tell us what happened rather than only that something did — a report with a reason is far more actionable than one without. Please do not file reports you know to be false.

What we do about reports. Depending on what we find, we may reclaim a name, remove a friendship, suspend an account, close one permanently, or report the matter to the police or another authority. We will act proportionately, and where it is reasonable we will tell the person concerned why.

6. The daily puzzle, and who owns what

Our part. The Be Pieceful name, design, code, artwork, mascot, and the way the game works belong to us. You may play the game, but you may not copy, resell, or build a competing service out of it, and you may not reverse-engineer or scrape it.

The photographs. Puzzle images come from Unsplash and remain the property of the photographers who made them. We use them under the Unsplash API terms, which permit us to display them in the game with attribution. That permission does not pass to you: you may not download, extract, redistribute, or reuse puzzle photographs from Be Pieceful. If you want to use a photo, get it from Unsplash directly, where the photographer's own terms apply.

Your result. The time you post and the streak you build are yours to share however you like.

7. Playing fairly

Please do not:

  • use bots, scripts, automation, or modified clients to complete puzzles, submit times, or earn pieces
  • attempt to access a puzzle before its release date, or to extract the day's image ahead of time
  • interfere with, overload, or probe the service, or work around rate limits or bot protection
  • register player names in bulk, or hoard them
  • impersonate another player, a real person, or us
  • harass, threaten, or abuse another player, or evade a block
  • post spoilers or completed-board images in a way designed to ruin the puzzle for other people
  • use Be Pieceful for anything unlawful

8. Streaks, times and statistics

Streaks and solve times are a game feature, not a record of account. We may correct, reset, or discard times, streaks and pieces where we have good reason to think they resulted from automation, manipulation, or a bug in our own software. Where the cause was our bug, we will try to restore rather than remove.

If you delete your account, your streak goes with it. We cannot recover it afterwards.

9. Pieces, the shop and your habitat

Pieces are earned by playing, and cannot be bought with money. You earn them by finishing puzzles, with a bonus that grows with your streak, and you spend them on cats, koi and decorations for your habitat.

Because they are a game feature rather than a product, please be clear about what they are:

  • Pieces have no cash value. They are not money, not credit, and not property. They cannot be exchanged for money, transferred to another player, or sold.
  • We may change how pieces are earned and what things cost as we tune the game. What you have already bought stays bought at the price you paid.
  • Pieces and the items you own are tied to your devices and, if you have one, your account. They do not survive account deletion, and we cannot restore them afterwards.
  • Everything in the shop is cosmetic. Nothing you can buy with pieces changes the puzzle or makes it easier.
  • We may retire catalogue items. If we do, we will not take away one you already own.

10. bepieceful+

bepieceful+ is an optional paid tier. The daily puzzle is free without it, and always will be.

What it includes. The full puzzle archive rather than the most recent month, an ad-free experience, offline play, and pieces earned at double rate. We may change what bepieceful+ includes; if we remove something significant, we will tell you before your next renewal so you can decide whether to keep it.

Buying it. Purchases are made through Apple, not through us. Apple is the seller, Apple charges you, and the price you see at the moment of purchase is the price that applies in your country's storefront. We never see your card details.

Subscriptions renew automatically. A monthly or yearly subscription renews at the end of each period at the then-current price, and is charged to your Apple ID, unless you cancel at least 24 hours before the period ends. Any free or introductory period ends as soon as you buy a subscription, and the unused part of it is forfeited.

Cancelling. You cancel in your Apple ID subscription settings, not in Be Pieceful — we have no ability to cancel it for you. Cancelling stops the next renewal; you keep bepieceful+ until the end of the period you have already paid for.

Lifetime. The lifetime option is a one-off purchase, not a subscription, and it does not renew. "Lifetime" means for as long as Be Pieceful operates as a service — it is not a promise that the service will run for the whole of your life, and section 12 (we may stop offering the game) applies to it. If we ever shut Be Pieceful down we will say so as far ahead as we reasonably can.

Refunds. Refunds are handled by Apple under its own policies, and we cannot issue one. Ask Apple at https://reportaproblem.apple.com. If something we did broke what you paid for, tell us at [support@bepieceful.com] and we will help you make that case.

If you are a consumer in the UK or the EU, you normally have a 14-day right to change your mind about a digital purchase. By downloading content or using bepieceful+ straight away you agree the service starts immediately, and you lose that right once it has been fully performed. Apple's own process applies to the refund itself, and none of this affects rights you have that cannot be excluded by agreement.

If your subscription lapses, you keep everything you earned. You simply stop getting the bepieceful+ extras — the archive returns to the most recent month, and pieces go back to the normal rate.

11. Reminders

You can turn on a daily reminder in the app. It is scheduled and delivered by your own phone, and you can turn it off in Be Pieceful's settings or in iOS Settings at any time. We send no push notifications and no marketing messages.

12. Changes to the game

Be Pieceful is free to play, and we are still building it. We may change how it works, add or remove features, or stop offering it altogether. We will try to give reasonable notice of anything major, but we do not promise that a puzzle will be available every single day, or that the service will be uninterrupted. Where a change materially reduces something you have paid for, section 10 applies.

13. Ending your use

You can stop using Be Pieceful at any time, and delete your account from your account settings — in the app as well as on the web.

Deleting your account removes your account record, your player name, your friendships and your blocks. Your player name is held unusable for 30 days and then becomes available to somebody else. Pieces and the items you own do not survive. Deleting your account does not cancel a bepieceful+ subscription — cancel that in your Apple ID settings, or you will keep being charged.

We may suspend or close your account if you break these terms, if it is necessary to protect other players or the service, or if we are legally required to. Where it is reasonable to do so, we will tell you why first. If we close your account for something you did, we are not required to refund a subscription — though Apple may still choose to.

14. Disclaimers

Be Pieceful is provided "as is" and "as available". We do not promise that it will be error-free, uninterrupted, secure, or that any defect will be fixed. To the extent the law allows, we exclude all warranties that are not expressly set out in these terms.

We do not control what other players do. We take reports seriously and act on them, but we do not pre-screen player names or friend requests, and we cannot promise that no player will ever behave badly toward you.

15. Our liability to you

The daily puzzle is free of charge. To the fullest extent the law allows, our total liability to you for anything connected with the game is limited to [£100 / $100], or the amount you have paid us for bepieceful+ in the twelve months before the claim if that is greater, and we are not liable for lost data, lost streaks, lost pieces, lost profits, or any indirect or consequential loss.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. If you are a consumer, you keep all the statutory rights the law of your country gives you, and nothing here affects them.

16. Governing law and disputes

These terms are governed by the law of [ENGLAND AND WALES — CONFIRM], and the courts of [ENGLAND AND WALES] have jurisdiction.

If you are a consumer living elsewhere in the UK or in the EEA, you keep the protection of the mandatory consumer laws of the country you live in, and you may bring proceedings there.

There is no arbitration requirement and no class-action waiver in these terms.

17. If you use the iOS app

Apple requires us to state the following, and these apply only to the App Store version:

  • These terms are between you and us, not you and Apple. Be Pieceful and its content are our responsibility, not Apple's.
  • Apple has no obligation to provide any support or maintenance for Be Pieceful. Support requests go to [support@bepieceful.com].
  • If the app fails to conform to any warranty that cannot be excluded, you may tell Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation in respect of the app.
  • Apple is not responsible for addressing any claim you or a third party makes about the app — including product liability claims, claims that it fails to conform to a legal requirement, and claims under consumer protection or privacy law. We are.
  • If a third party claims the app infringes their intellectual property, we, not Apple, are responsible for investigating and resolving it.
  • You confirm you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and that you are not on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms, and may enforce them against you as they relate to your use of the app.

18. General

If any part of these terms turns out to be unenforceable, the rest continues to apply. If we do not enforce something straight away, we have not given up the right to do so later. We may transfer these terms to a new operator of Be Pieceful; you may not transfer your account or your player name to someone else. These terms are the whole agreement between us about the game.
